Terms of Use www.designresearchnetwork.org (Part A-see below); Terms of Use “Doktorandenforum” (Part B-see below) A. Terms of Use www.designresearchnetwork.org If only the website www.designresearchnetwork.org is used, the www.designresearchnetwork.org (A.) Terms of Use are exclusively applicable. 1. Parties to the Agreement The Parties to the Agreement are the Deutsche Telekom AG, T-Laboratories, the research and development institute of Deutsche Telekom - An-Institut of Technische Universität Berlin … (hereinafter referred to as “T-Labs”), Ernst-Reuter-Platz 7, 10587 Berlin and the user. 2. Subject matter of the Agreement The Subject matter of the Agreement arises from these Terms of Use. These regulate the gratuitous use of the website www.designresearchnetwork.org within the framework of the technical and operational resources. 3. Services of T-Labs a. On www.designresearchnetwork.org T-Labs provides data and information for students, scientific assistants and others interested in research. With respect to the use of further services at www.designresearchnetwork.org, their use is subject to special terms of use (e.g. utilization of the “Doktorandenforum“). T-Labs shall point this out explicitly, where applicable. b. T-Labs reserves the right to change, amend, remove or discontinue the data and information provided on www.designresearchnetwork.org or www.designresearchnetwork.org in its entirety any time and without notice. T-Labs is not obliged to keep a specific offer available. 4. Rights and obligations of the user a. www.designresearchnetwork.org contains, among others, data and information subject to copyright and/or brand name protection which are provided by T-Labs as the creator of the database. The rights in accordance with § 87 b UrhG (German Copyright Act) – rights of the database´s creator remain reserved for the benefit of T-Labs, in particular the right to further commercial use. In particular, it is prohibited to download, copy in any way, change, disseminate, store, present, transmit, hire out, borrow or utilize the database provided by T-Labs in full or in part, especially text, parts of text, data and/or audio data. b. The user is only entitled to technically necessary duplication for browsing purposes (access to the website and display of the website and its content) insofar as this is not done for commercial purposes. Furthermore, the user is allowed to make permanent copies of data and information for personal use. c. A hyperlink (Internet link) may be placed on the website to exclusively serve as a cross reference. T-Labs reserves the right to withdraw this permission. It is not permitted to show this website in a frame. 5. Warranty a. T-Labs does not guarantee permanent and comprehensive availability of www.designresearchnetwork.org, which may for instance be affected by interruptions of the server, public communication networks, power supply or by other circumstances beyond the control of T-Labs. b. T-Labs furthermore reserves the right to restrict the services within reason, for the purpose of maintenance work and further development, insofar as this is necessary for proper or improved operation. c. T-Labs does not guarantee that the information provided on www.designresearchnetwork.org is complete, accurate or up-to-date in all cases. This also applies to any links to which www.designresearchnetwork.org may refer, directly or indirectly. T-Labs shall not be held responsible for the contents of a page accessed via such a link. d. For the rest, liability is in accordance with Section 6. 6. Liability a. T-Labs shall be fully liable for any damage caused intentionally or by gross negligence or if the damage is attributable to the lack of a guaranteed feature. b. In the event of slight negligence, T-Labs shall be fully liable in case damages arising from death and injury to body and health. c. Liability shall otherwise be excluded, although liability arising from the Product Liability Act shall not be affected hereby. 7. Final provisions The laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods, shall apply. B. Terms of Use “Doktorandenforum” Deutsche Telekom AG, T-Laboratories (hereinafter referred to as “T-Labs“) operates the communication platform accessible at www.designresearchnetwork.org (hereinafter referred to as “Doktorandenforum“). The Doktorandenforum is a free online community with the objective to support users in establishing contacts, social networks and communities of interest. The user has options to utilize various services. 1. Subject matter of the Agreement The Subject matter of the Agreement arises from these Terms of Use and regulates satellite usage as well as utilization of cross-network services within the framework of the technical and operational capabilities. 2. Conditions for conclusion of the Contract / Contract realization a. The registration process requires the user to complete and transmit an application form with his user name and password as well as other personal data (in particular his e-mail address). All the fields defined as obligatory fields must be filled out correctly and in full. When this is done, the user may utilize all (free) functions of the Doktorandenforum for the duration of his visit after his first login. An e-mail containing a link is simultaneously sent to the user’s e-mail address (so-called double-opt-in procedure). The registration process is complete as soon as the user activates the link. The contract of use comes into force after user authorization by T-Labs. b. T-Labs verifies the validity of the postal address should the user voluntarily provide the street and house number. 3. Obligations and responsibilities of the user a. The Doktorandenforum is intended solely for personal and non-commercial usage. The user is legally responsible for the content that he submits to the site and must therefore ensure that such content does not constitute an infringement current legislation. The following obligations in particular apply: (i) The services provided shall not be misused, in particular: - no unlawful, unsolicited information, material or other services may be distributed, including unsolicited and uninvited advertising by e-mail, fax, telephone or SMS. - no unlawful contact using telecommunication services (§ 238 StGB) (German Penal Code) may be made. - no information containing illegal content or content in violation of accepted moral standards may be transmitted or posted on the Internet, nor may reference to such information be made. This shall include in particular content that, as defined in §§130, 130a and 131 StGB (German Penal Code), incites hatred and violence against segments of the population, leads to criminal offences or glorifies or trivializes violence, is sexually offensive, is pornographic pursuant to § 184 StGB (German Penal Code), is apt to seriously endanger the moral welfare of children or youths, or affects their general welfare, or could damage the reputation of T-Labs. The provisions of the Agreement of the German Federal States regarding the Protection of Human Dignity and Juveniles in Radio and Televised Media (Jugendmedienschutzstaatsvertrag - JMStv) and the Juvenile Protection Act (Jugendschutzgesetz) shall be complied with. - it must be ensured that the use of individual functions and, in particular, the creation or sending of messages does not cause any disruption to T-Labs, other providers or any other third parties. - national and international copyrights, trade mark-, patent-, name- and labeling rights as well as other industrial property rights and personal rights of third parties shall be observed, in particular no content protected under immaterial property laws, illustrations and presentations (for instance copyrighted music, films, video clips or software) may be stored, published or disseminated without the user having granted the necessary rights. The user must always respect other people's right to privacy. It is therefore prohibited to store or disseminate molesting, insulting or threatening content. Photographs and videos showing images of persons may not be published or distributed without obtaining permission from the persons they show. (ii) It is prohibited in particular: - to execute any application that could have an adverse impact on or make changes to the Doktorandenforum (especially denial-of-service attacks). - to attempt to gain unauthorized access to third party data (especially hacking the system). b. To enable T-Labs to provide the extraordinary service the user shall grant T-Labs the right, unrestricted in time and space, to reproduce, modify, disseminate and publish his content to the extent that this is necessary for the operation of the Doktorandenforum. In any event, the user grants T-Labs all rights required for proper operation of the Doktorandenforum. c. All material provided by T-Labs or by third parties, in particular text, software and graphics, is copyrighted – as an individual service as well as collectively. The user is only permitted to download and use this material within the scope defined by this Agreement and within the scope defined by the UrhG (German Copyright Act). It is prohibited for users to reproduce, copy, transmit, sell, publish, put to commercial use or transmit it in any other way electronically, or to convert it by any other means into a different data format. d. If the user infringes the obligations imposed under the current Section 3. a. and Section 3. c., he is obliged to compensate T-Labs for any expenses incurred, and to exempt and indemnify T-Labs against all claims for damages and claims for reimbursement of expenses made by third parties, resulting from the user's infringement. This also applies to damage caused by others to the extent that the user can be held responsible. Damages for which T-Labs must be compensated include in particular any costs incurred for attorney's fees. This does not in any way prejudice any further rights or claims for damages of the T-Labs. e. Personal access data (e.g. user ID, password) may not be provided to third parties and must be kept in a location that is protected against third-party access. For security, the data must be changed regularly. If there is reason to suspect that the access data has been disclosed to unauthorized persons, the user must change the data immediately. The user is liable for any unauthorized use of his stored data that he makes possible with his actions. f. The user shall secure his stored data at intervals appropriate to the application and in a form suitable for recovery of the data at acceptable cost. g. In order to avoid or divert possible damage, T-Labs has the right, in case of severe infringements of the customer's obligations in accordance with Section 3. a. to 3. c., or well-founded serious suspicion of breach of duty, to block the specific service at any time for all or certain parts of the user’s content, including his home page, without prior agreement by the user. 4. Modifications to the Terms of Use If T-Labs intends to make any changes to the Terms of Use, service specifications or prices, the user shall be notified in writing no later than six weeks prior to the effective date of the changes. In the event of any amendments to the Terms of Use and the service specifications or in the event of price increases, the user shall be entitled to special termination, effective from the time the changes go into effect. T-Labs shall make specific reference to this special termination right in the change notification. If the user does not terminate the Agreement in writing within six weeks after receipt of the change notification, the changes shall become part of the Agreement from the date they go into effect. 5. Warranty The provisions in Part A. Section 5 shall apply accordingly. 6. Liability The provisions in Part A. Section 6 shall apply accordingly. 7. Termination of the License Agreement a. The user may give notice of termination of this Agreement at any time without giving reasons. Notice of termination must be submitted with the user name and e-mail address under which the user registered with the union to info@designresearchnetwork.org b. After receipt of the notice of termination, the records stored for the user's profile as well as the master data and all files and data of the user stored at T-Labs (e.g. messages in the Inbox etc.) will be deleted. c. T-Labs is entitled to terminate the Agreement by e-mail sent to the user’s registered e-mail address, with 14 days’ notice. Section 7. b. shall apply accordingly. d. This shall be without prejudice to the right to terminate the Agreement for good cause. In particular, in the event that the user seriously or permanently violates his obligations, T-Labs is entitled to terminate the Agreement without a notice period. 8. Data protection T-Labs's Data protection guidelines shall apply. 9. Transfer of contractual relationships T-Labs is entitled to transfer the rights and obligations arising from this Agreement to an affiliated company, in compliance with §§ 15 ff. AktG (German Stock Corporation Act). 10. Final provisions The laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods, shall apply. Notes on data protection The protection of your personal data is of special concern to Deutsche Telekom AG, T-Laboratories (the research and development institute of Deutsche Telekom AG. An-Institut of Technische Universität Berlin – “T-Labs”). Please read on for information on how we ensure the confidentiality of your data. User data We process and use the data which is required for mutual due implementation of the agreement (customer data) and recorded at signing of the agreement and during the term of the agreement. This includes the title, first and family name, address, date of birth, phone number and/or e-mail address. Storage period of customer- and traffic data Unless there are legal provisions requiring further processing, particularly storage of data, or unless we have specific consent by law or yourself, your data will be deleted at the end of the calendar year following termination of the agreement The IP address allocated in each case is used exclusively to combat misuse and is deleted seven days after the connection ended.
